La contrattazione collettiva nella sanità pubblica e privata : prospettive e tecniche di tutela dei lavoratori della cura

Il contributo sottopone ad analisi alcuni fra i contratti collettivi più applicati in ambito sanitario, concentrandosi sulle componenti retributive di base. Constatata la diffusione del fenomeno - comune ad altri settori - del dumping contrattuale, l'Autore ferma l'attenzione sull'ampia libertà concessa agli enti e alle imprese private che operano in accreditamento con il servizio sanitario nazionale quanto alla scelta del contratto collettivo. Attraverso una rilettura della sentenza della Corte costituzionale n. 113/2022, l'Autore perviene a sostenere che l'introduzione dell'obbligo di applicare il contratto collettivo stipulato dalle associazioni sindacali comparativamente più rappresentative nel settore potrebbe configurare una tecnica antidumping efficace e compatibile con il sistema. The contribution analyses some of the most widely applied collective agreements in the healthcare sector, focusing on the basic salary components. Having noted the spreading of the phenomenon - common to other sectors - of contractual dumping, the author focuses on the wide freedom granted to private entities and companies accredited with the national health service as regards the choice of collective agreement. Through a reinterpretation of Constitutional Court ruling no. 113/2022, the author comes to the conclusion that the obligation to apply the collective agreement stipulated by the most representative trade union associations in the sector would configure an effective anti-dump-ing technique compatible with the system.
