La "fondamentalità" dei diritti fondamentali

  • Lo scritto fa oggetto di studio le più salienti articolazioni ed espressioni della "fondamentalità", quali si rendono palesi a) dall'attitudine dei diritti che la possiedono a porsi a fondamento dell'ordinamento in cui se ne ha il riconoscimento e, però, allo stesso tempo, di essere dallo stesso quodammodo fondati; b) dalla proprietà della "fondamentalità" di porsi a fondamento della inviolabilità dei diritti; c) dall'attitudine di ciascuno dei diritti in parola a porsi a fondamento anche degli altri della medesima specie; d) dal carattere della "fondamentalità" quale cerniera che dà modo a più ordinamenti (e, segnatamente, a quello statale ed a quello dell'Unione europea) di integrarsi a vicenda, grazie appunto al riconoscimento di diritti omnicondivisi, pur se fatti oggetto da parte degli ordinamenti medesimi di discipline in parte diverse l'una dall'altra.   • The essay deals with the most salient articulations and expressions of "fundamentality," as they become evident from: a) the attitude of the rights that possess it, both in positioning themselves as the foundation of the system in which they are recognized, and yet, at the same time, being somehow founded by it; b) the property of "fundamentality" in establishing the inviolability of rights; c) the propensity of each of these rights to also serve as the foundation for others of the same kind; d) the nature of "fundamentality" as a hinge that allows various systems (specifically, the state and the European Union) to integrate with each other, precisely due to the recognition of universally shared rights, albeit subject to partly different regulations within those systems themselves.
