Multiple discrimination in Swiss legal discourse

  • The author examines the extent to which multiple discrimination is a topic in Swiss legal discourse. Attention is directed to three central discourse actors: Firstly, the state, where it is found that multiple discrimination is barely mentioned in laws and judgements, with a few exceptions; only specialised administrative authorities have recently been trying harder to address specific intersectional problem areas by means of co-operation. Secondly, the author analyses the civil society discourse and particularly the aspect of advocacy and litigation for the representation of interests, which is organised mono-categorially for the most part. Finally, the article turns its attention to legal theory which, with the exception of isolated contributions, has recently engaged in more in-depth analysis. The author explains the lack of discussion partly in terms of the hierarchizing in existing law, strategic and political considerations, and blind spots of those actors who bear responsibility for the mobilisation of
