  • Nel saggio, l'Autore affronta il tema della riforma dell'art. 2103 c.c. - realizzata dal Jobs Act - in chiave comparata e nello scenario più generale di trasformazioni dell'impresa e della sua organizzazione, rileggendo le modifiche normative alla luce dei processi di profonda differenziazione del lavoro nei diversi settori produttivi. In questa prospettiva interpretativa, la disposizione codicistica viene analizzata modificando l'apparato concettuale di riferimento e provando a innestare nuove ipotesi ermeneutiche sul ceppo esegetico più tradizionale: come cambia il rapporto tra fonti e il ruolo degli attori della regolazione, come cambia la funzione di controllo del giudice e, infine, come cambia lo stesso contenitore giuridico dell'istituto - vale a dire il contratto di lavoro e il suo fondamento teorico-concettuale.   • In the essay, the Author deals with the issue of the reform of art. 2103 of the Civil Code - realized by the Jobs Act - in a comparative perspective and in the more general scenario of the transformations of the enterprises, analyzing the regulatory changes in the light of the existing profound differentiation of work in the various productive sectors. In this broad perspective, the norm of the Civil Code is analyzed through a modification of the current conceptual background. The Author tries to build new hermeneutical hypotheses, different from a more traditional exegetical approach, analyzing: how the relationship between legal sources and the role of the actors involved in regulation changes, how the judiciary function changes and, conclusively, how the legal framework of the institution in itself changes - i.e. the employment contract and its theoretical-conceptual basis.
