Dalla "proprietà estrattiva" alla sostenibilità urbana nelle locazioni turistiche : il ruolo del diritto privato

L'autore esamina il fenomeno delle locazioni turistiche brevi come espressione di un esercizio "estrattivo" della proprietà alla luce della crescente tensione tra interesse individuale, sostenibilità urbana e tutela di interessi collettivi e generali. Dopo aver ricostruito il quadro regolatorio europeo e nazionale, il saggio esamina la relazione tra locazioni turistiche e funzione sociale della proprietà, evidenziandone le ricadute sul mercato abitativo, sulla qualità della vita urbana e sul territorio. Su queste basi, il contributo indaga il ruolo del diritto privato e del giudice nel promuovere condotte virtuose nell'ottica della sostenibilità, mostrando come, pur entro i limiti propri degli strumenti privatistici, l'interesse generale possa orientarne l'interpretazione in chiave costituzionalmente conforme. The author examines the phenomenon of short-term rentals (STRs) as an expression of property "extractivism", against the backdrop of the growing tension between individual interest, urban sustainability, and the protection of collective and general interests. After reconstructing the European and domestic regulatory framework, the article explores the relationship between STRs and the social function of property, highlighting their impact on the housing market, urban quality of life, and the territory. On this basis, the contribution investigates the role of private law and of the courts in fostering virtuous conduct from a sustainability perspective, showing how, despite the inherent limits of private-law remedies, the general interest may guide their interpretation and application in a constitutionally consistent manner.
