  • Il saggio è dedicato all'analisi delle posizioni giuridiche soggettive del militare in servizio, da vagliare in rapporto ai limiti del potere decisionale dei superiori gerarchici. Si distinguono posizioni di diritto soggettivo ad esercizio condizionato e posizioni di interesse legittimo, oltre ad interessi di mero fatto. La qualificazione è necessaria al fine di stabilire la profondità del sindacato del giudice amministrativo sul contenuto delle decisioni. Sulla base della casistica esaminata, si formulano alcune considerazioni finali sulle caratteristiche del sindacato. Si reputa che l'attuale disciplina, per quanto finalizzata a garantire l'efficienza degli apparati militari, non sia del tutto coerente con i principi desumibili dagli artt. 24, 52 e 97 Cost.   • The essay deals with the decisions addressed to the soldier in service. The author examines the the judicial review of the decisions and explains how it affects the condition of the soldier. It's argued that the rights of the soldiers have less protection than the rights of citizens, because every soldier is subject to the orders of their hierarchical superiors. Such orders cannot be subject to indepth review, as judicial control would make their execution inefficient. Consequently, the position of the military cannot be fully assimilated to that of citizens, even with reference to the enjoyment of fundamental rights. [Publisher's text].
