  • Considering the Transparency Decree (D. lgs. 33/2013: "Reorganisation of the Rules concerning the Obligations of Publicity, Transparency and Dissemination of Information by Public Administrations") the starting point of these reflections, I'm goingo to unravel a brief examination about the balance of two constitutional rights: the right to a well performing public administration and the right to privacy. A balance that would become increasingly difficult as a result of the Transparency Decree which claims to fight corruption implementing a democratic principle that demands public administrations to publish almost all the acts in their possession (exception made for sensitive data and other specific personal data). A potential risk, resulting from this decree, is that the glass house of administration is going to be transformed into a Big Brother's House, a place where, paraphrasing Michel Foucault, monitoring is punishing.
  • The actual risk is that trough transparency as well as corruption would be eliminated also the freedom. [Publisher's text].
