Ucraina e Gaza : il diritto internazionale alla prova dei conflitti contemporanei

L'autrice riflette sulla tenuta delle attuali norme di diritto internazionale alla luce dei recenti conflitti in Ucraina e a Gaza. Dopo aver illustrato come si sono dapprima formate e poi modificate le regole sul divieto dell'uso della forza, sull'autodeterminazione dei popoli e sulla responsabilità penale individuale, l'autrice esamina le reazioni all'aggressione russa all'Ucraina e alla guerra scatenata da Israele a Gaza dopo gli attacchi del 7 ottobre. Da un lato analizza la reazione degli stati e dall'altro quella della Corte internazionale di giustizia e della Corte penale internazionale. L'atteggiamento degli stati assume particolare importanza al fine di valutare se le norme internazionali sul divieto dell'uso della forza, sull'autodeterminazione dei popoli e sulla responsabilità penale individuale sono state violate o se si stanno modificando. The author reflects on the resilience of current international law in light of the recent conflicts in Ukraine and Gaza. After illustrating how the rules on the prohibition of the use of force, self-determination of peoples, and individual criminal responsibility were formed and modified, the author examines the reactions to Russia's aggression against Ukraine and the war unleashed by Israel in Gaza following the October 7 attacks. On the one hand, she analyses the reactions of states; on the other, those of the International Court of Justice and the International Criminal Court. The attitude of states is particularly important in assessing whether international norms on the prohibition of the use of force, the self-determination of peoples, and individual criminal responsibility have been violated or are changing.
