  • Lo scritto analizza le recenti normative che hanno incrementato i poteri speciali di controllo sugli investimenti esteri nel contesto dei rapporti tra Stato e mercato. Sono studiati i profili organizzativi che investono la Presidenza del Consiglio dei ministri; le procedure istruttorie e valutative, sia a livello nazionale, sia europeo; gli obblighi delle imprese. L'autore mette in luce come sia cambiata la ratio dell'istituto che, da eccezionale e limitato mezzo di protezione contro paventate aggressioni economiche provenienti da Paesi extra UE, è divenuto uno strumento di controllo esteso a pressoché tutto il sistema economico, finalizzato a proteggerlo nella sua interezza, anche in occasioni che prescindono del tutto dall'ingresso di capitali stranieri.   • The paper analyses recent regulations that have increased the special powers of control over foreign investments in the context of the relationship between the state and the market. These are the following items studied in the article: the organizational profiles of the Presidency of the Council of Ministers; the investigation and evaluation procedures, both at national and European level; the obligations of companies. The author highlights how the rationale of the institute has changed from an exceptional and limited means of protection against alleged economic aggression from non-EU countries, has become an instrument of control extended to the entire economic system, aimed at protecting it in its entirety, even on occasions that completely disregard the entry of foreign capital.
