- The paper deals with the professio donationis, a praxis contrasted in a few imperialconstitutions of the Severian and Diocletian age handed down by theVaticana Fragmenta, aiming at achieving a donatio perfecta without the traditio ofthe res donata. Through the analysis of the phenomenon and the comparisonwith the legal uses of the eastern provinces of the Empire it is highlightedthat this praxis represents an example of a misunderstanding application ofRoman law in those territories that is not reflected in the West.
