Mutamenti costituzionali : un'analisi concettuale

  • Il tema delle modificazioni tacite della costituzione è reso oscuro dalla sovrapposizione tra mutamenti intervenuti nell'interpretazione del testo e violazioni del testo stesso. Questo genera una confusione che è assai frequente a proposito della c.d. forma di governo, che in Costituzione è marcata con pochi ma essenziali tratti. Più complicato è valutare se siano intercorsi mutamenti nella costituzione economica, che è un tema molto complesso che coinvolge molte parti della Costituzione. Chiarendo che per lo più sono mutate le interpretazioni e applicazioni della Costituzione, nell'ambito di opzioni lasciate libere dal testo, il saggio conclude sottolineando come il sistema sia dotato di meccanismi di reazione e di ristabilimento della legalità costituzionale.
