La dimensione giuridica della pace tra ordinamento nazionale ed ordinamento dell'Unione europea alla luce dei più recenti interventi in materia

Pace e rifiuto della guerra sono stati i capisaldi della "Dichiarazione Schuman" sulle cui fondamenta è stata costruita l'Europa, che ha visto riconoscersi il Premio Nobel per la pace nel 2012 e che oggi deve fronteggiare le più grandi minacce per la sua sicurezza dal Secondo dopoguerra. Oggi, la pace non è più un bene scontato in Europa con il ritorno di una guerra di tipo convenzionale ai confini dell'Unione fin dal 2022. Inoltre, in considerazione anche del rischio quantomai concreto di un disimpegno americano per la difesa del Vecchio Continente, è inevitabile prevedere per l'Unione europea non solo una maggiore assunzione di responsabilità per la sicurezza sua e dei suoi cittadini ma, fatto alquanto auspicabile, anche, un rinnovato ruolo di grande pacificatore mondiale.

Il lavoro, pertanto, si propone di analizzare il valore della pace sulla base di una introduzione di carattere filosofico e storico; di seguito, verrà condotta un'analisi non solo della giurisprudenza nazionale e di quella europea ma anche del diritto positivo. In ultimo, saranno analizzati anche i più recenti atti delle Istituzioni. La loro lettura congiunta, infatti, consentirà di valutare in qual modo l'Unione ha inteso tutelare questo nobile valore e, soprattutto, dinanzi alle sfide che le si pongono nel presente e nel tempo a venire, in qual modo intenderà perseguirlo [Testo dell'editore].

Peace and the rejection of war were the cornerstones of the "Schuman Declaration" upon whose foundations Europe was built, a Europe that was awarded the Nobel Peace Prize in 2012 and that today must face the greatest threats to its security since World WarII. Nowadays, peace is no longer a given in Europe with the return of conventional warfare on the Union's borders since 2022. Moreover, considering the very real risk ofAmerican disengagement from the defense of the Old Continent, it is inevitable to foreseefor the European Union not only a greater assumption of responsibility for its own security and that of its citizens but, also, a highly desirable development, a renewed roleas a major global peacemaker.

Therefore, this work aims to analyze the value of peace,starting with a philosophical and historical introduction; subsequently, an analysis will be conducted not only of national and European case law but also of positive law. Finally,the most recent acts of the Institutions will be examined. Indeed, their combined reading will enable an assessment of how the Union has sought to safeguard this noble value and,above all - in the face of the challenges confronting it in the present and in the future - how it intends to pursue it [Publisher's Text].
