  • Il volume affronta gli snodi di interesse specificamente canonistico-procedurali delle complesse questioni relative alle sfide pastorali sulla famiglia nel contesto dell'evangelizzazione, esaminate dall'Assemblea Sinodale straordinaria del 5-19 ottobre 2014. Prese in esame alcune questioni aperte – quali il rapporto tra contratto e sacramento nuziale, la necessità della fede per la validità del consenso matrimoniale e l'integrazione dei fedeli divorziati e risposati nella Chiesa – l'attenzione viene rivolta sia ad un possibile rinnovamento del sistema matrimoniale canonico alla luce delle provocazioni sinodali, sia alle proposte concrete emerse nel dibattito e nei documenti sinodali, sia infine alle direttive della Segnatura Apostolica a riguardo di un più accessibile e agile accertamento della verità per la verifica delle nullità matrimoniali.

  • The complex issues concerning the pastoral challenges of the family in the context of evangelization which have been under the scrutiny of the Extraordinary Synodal Assembly (October 5-19, 2014) raised extensive discussions among theologians, pastoral and canon law experts, and all those facing those challenges in their marriages and families. The volume looks into the issues discussed by the Synod which have canonical-procedural implications. After delving into a number of open questions – the relationship between contract and the sacrament of marriage, faith as essential element of valid marriage consent, the integration of the divorced and civilly remarried in the Church – the contributions analyze the following topics.
  • Possible ways to renew Canonical Marriage System in the directions suggested by the Synod; practical proposals that emerged in the synodal debates and documents; the directives of the Apostolic Signature aimed at making the establishment of the truth in order to ascertain the marriage nullities more accessible and agile. Issues: rapidity and simplicity of the marriage processes, quaestio semper urgens; debated issues in the Relatio Finalis of the III Extraordinary Synod ; renewal of the Canonical Marriage System; a more accessible and agile establishment of the truth: formation of the legal professionals and bishop responsibility; the experience of the Apostolic Signature.
